China Law Blog Prevails in China Trademark Dispute

Well, not exactly.  Earlier this week, we discovered a recently created blog calling itself "China Law Blog."  This blog, which has postings in both English and in Chinese, had been started at the beginning of this year by Shenzhen attorney, Dr. Weidong Lee. 

I wrote Dr. Lee, pointing out to him that we had gotten to the "China Law Blog" name first and asking him to change his blog name so as not to conflict with ours.  Dr. Lee immediately responded by saying that he had already renamed his blog "China Lawyer Blog."  Thank you Dr. Lee.

The lesson to be learned here -- and it is, of course, somewhat painful to reveal this -- is that not every problem is a legal problem and not every impingement is deliberate.  Even in these legalistic times, the best and cheapest solution to a problem is often not to call in the lawyers, but rather, to try to work it out.  The only proviso when trying to work it out is that one must be careful not to reveal information that may make things more difficult if litigation eventually ensues.  Of course, it always helps when you are dealing with someone as reasonable as Dr. Lee.
